A passport furnished with a photograph of the holder, or some other document establishing to the satisfaction of an immigration officer or immigration assistant the identity and nationality, domicile or place of permanent residence of the holder: Immigration Ordinance (Cap 115) s 2. Blank passports are held not to be ‘travel documents’: R v Stuchiner [1997] 2 HKC 271. The Central People’s Government can authorise the Government of the Hong Kong SAR to issue, in accordance with law, passports of the Region to all Chinese citizens who hold permanent identity cards of the Region, and travel documents of the Region to all other persons lawfully residing in the Region: Basic Law art 154 para 1. Such passports and travel documents will be valid for all states and regions and will record the holder’s right to return to the Region: art 154 para 1. With effect from 1 July 1997, all Hong Kong Chinese compatriots may (whether or not they are holders of the British Dependent Territories citizen passport or British National (Overseas) passport), for the purpose of travelling to other countries and territories, continue to use the valid travel documents issued by the Government of the United Kingdom. However, they are not entitled to British consular protection in the Hong Kong Special Administrative Region and other parts of the People’s Republic of China on account of their holding the above mentioned British travel documents. In relation to human rights, the right to leave a country must include the right to obtain the necessary travel documents. The issuing of passports is normally incumbent on the state of nationality of the individual. The refusal by a state to issue a passport or prolong its validity for a national residing abroad may deprive this person of the right to leave the country of residence and to travel elsewhere: Vidal Martins v Uruguay Communication No 57/1979; Basic Law art 154 para 1.
