| 释义 | 旅遊合約 An agreement between two or more parties, that is enforceable at law, for the purpose of undertaking a journey from one place to another. The terms of the agreement include price, place and date of the journey, means of conveyance, and/or accommodation. The Supply of Services (Implied Terms) Ordinance implies into a contract for the supply of a holiday or other travel services the term that the supplier of such services, if he is acting in the course of business, will carry out the service with reasonable care and skill: Supply of Services (Implied Terms) Ordinance (Cap 457) s 5. An express term of the contract does not negative such an implied term unless inconsistent with it: s 8(3). Although a right, duty or liability arising out of a contract for the supply of service may be negated or varied by express agreement, or by the course of dealing between the parties, or by such usage as binds both parties to the contract, a party to the contract cannot, by reference to any contract term, exclude or restrict any liability of his arising under the contract by virtue of this implied term as against the other party where such party deals as consumer: s 8(1), (2).
