| 释义 | 旅遊業賠償基金 A fund established under the Travel Agents Ordinance (Cap 218), which consists of (1) money received on account of the Fund levy; (2) money paid to the Travel Industry Compensation Fund Management Board by the Travel Industry Council of Hong Kong being the surplus reserves of the Travel Industry Council of Hong Kong; (3) money borrowed by the Board under its powers; (4) income from any investment made by the Board under its powers or transferred into the name of the Board from being that of the TIC Reserve Fund; (5) money paid into the Fund by the Board upon its becoming property of the Board upon transfer from being under the name of the TIC Reserve Fund to that of the Board; (6) any financial penalty collected or paid pursuant to the Travel Industry Compensation Fund (Amount of Ex gratia Payments and Financial Penalty) Rules; and (7) any other money paid into the Fund: Travel Agents Ordinance (Cap 218) s 32C(2). Travel agents are required to contribute to the Travel Industry Compensation Fund by way of levy: Travel Agents Ordinance (Cap 218) s 32H(1). The Fund levy is payable in respect of every outbound fare received by the travel agent concerned and is an amount ascertained in terms of a percentage of such outbound fare: s 32H(2)(a), (c). It must be paid by the travel agent to an authorised collector: s 32H(2)(b). See also Travel agent. 根據《旅行代理商條例》（第 218章）設立的一項基金，賠償基金由以下各項組成 (1) 就賠償基金徵費而收到的款項；(2) 旅遊業議會繳付給旅遊業賠償基金管理委員會（下稱委員會）的款項，即是香港旅遊業議會的盈餘儲備；(3) 委員會根據有關法定條文的權力借入的款項；(4)得自委員會根據法定條文的權力所作的或轉讓至委員會名下（即賠償基金儲備基金）的任何投資項目的收入； (5)由委員會在有關的款項一旦成為委員會的財產後，並在該等款項轉到委員會名下後，撥入基金的款項；(6)依據旅遊業賠償基金（特惠津貼款項及罰款）訂立的規則收集或繳付的任何罰款；及(7)撥入賠償基金的任何其他款項：《旅行代理商條例》 （第218章）第32C(2)條。旅行代理商有法律責任以繳付徵費方式，向賠償基金供款：《旅行代理商條例》（第218章）第32H(1)條。賠償基金徵費須就有關的旅行代理商所收到的每筆外遊費而繳付，並須參照該等外遊費的一個百分率確定款額：第32H(2)(a)及(c)條。須由該旅行代理商向獲授權收款人繳付：第32H(2)(b)條。另見 Travel agent。 |
