释义 | 輸精管切除術 A surgical procedure which removes part of the vas deferens from a man, the effect of which is to make it impossible for the man to father a child. A vasectomy is a form of contraception. It is necessary for the male undergoing the operation to consent to the operation. In relation to a child who is incapable of giving a valid consent, a declaration may be granted by the court that a particular treatment proposed, for example vasectomy, will not be unlawful; such a declaration is not a necessary pre-condition but it is highly desirable: Re F (Mental Patient: Sterilisation) [1990] 2 AC 1, sub nom F v West Berkshire Health Authority (Mental Health Act Commission intervening) [1989] 2 All ER 545 (HL). In tort law, a duty of care is owed by the doctor to the wife of a man who became pregnant after her husband underwent a negligently unsuccessful vasectomy, if the doctor intended her to receive advice in relation to the vasectomy: McFarlane v Tayside Health Board [1999] 4 All ER 961.
