A method of including terms in a contract by the execution (signing) of a written memorandum of the agreement. When the parties reduced their agreement into a document in writing, the party who signed such document will ordinarily be bound by the terms in that agreement irrespective of whether or not he has read them and whether or not he is ignorant of the precise legal effect of those terms: L’Estrange v F Graucob Ltd [1934] 2 KB 394. However, if the document signed is not obviously contractual in character the terms may not be incorporated in the absence of the adequate notice: Curtis v Chemical Cleaning and Dyeing Co [1951] 1 KB 805; Betty Ho Hong Kong Contract Law (1994) p 120-121.
