| 释义 | 猥褻侵犯 An assault accompanied by indecency: DPP v Rogers [1953] 2 All ER 644, 37 Cr App Rep 137, 1 WLR 1017. It is an offence for a person to indecently assault another person: Crimes Ordinance (Cap 200) s 122(1). The test of indecency is whether the conduct complained of would be considered by right-minded persons as offensive to contemporary standards of modesty and privacy: R v Court [1989] AC 28 (HL); R v Fong Chi Wai [1996] 2 HKC 300 (HC); HKSAR v Lau Kwai Chung [2000] 3 HKC 658 (CFI). The assault needs not be indecent in itself provided that it is accompanied by circumstances of indecency: Beal v Kelley [1951] 2 All ER 763, 35 Cr App Rep 128. No offence will be committed where the accused believes that the complainant is consenting to his conduct, whether his belief is based on reasonable grounds or not: R v Kimber [1983] 3 All ER 316, 77 Cr App Rep 225 (CA). Consent negatives indecent assault but only if the complainant is 16 or above and is not mentally incapacitated: Crimes Ordinance (Cap 200) ss 122(2), (4). However, consent cannot be a defence if the probable consequence of the alleged assault is infliction of bodily harm: R v Donovan [1934] 2 KB 498 (CCA). Common assault is an alternative verdict to indecent assault: Kwok Hung v R [1978] HKLR 173 (HC).
