1. Tend to prove the guilt of. The privilege against self-incrimination excuses a witness from giving particular evidence on the ground that the evidence may tend to prove that the witness has committed an offence or is liable to a civil penalty. A defendant in a criminal proceeding is not compellable to answer any question tending to criminate himself: Evidence Ordinance (Cap 8) s 10; Ho Sai Chu v Cheung Yun Sing [1993] 2 HKC 506. The right not to incriminate oneself cannot reasonably be confined to statements of admissions of wrongdoing or to remarks which are directly incriminating since even neutral evidence may be deployed in a way which supports the prosecution case: Halsbury’s Laws of Hong Kong, Vol 14, Human Right [210.171]. 2.
