| 释义 | 彌償基金 A fund established by the Law Society of Hong Kong under the Professional Indemnity Scheme (replacing the former Professional Indemnity Insurance Scheme since 1 October 1989), under which indemnity is provided exclusively out of the fund in satisfaction of claims of any civil description against a solicitor or former solicitor in connection with his practice, and any claim against a solicitor must be made solely against the fund: Solicitors (Professional Indemnity) Rules (Cap 159M) rr 2, 10(1), 12(1). Every solicitor who is, or who is held out to the public as, a solicitor in practice in Hong Kong is required to have and maintain the fund through annual contributions to the fund of the insurance fund: rr 6(1), 7(1), 11. The fund is held, maintained and administered by the Hong Kong Solicitors Indemnity Fund Limited: r 5. Also known as ‘Professional indemnity fund’. See also Professional indemnity insurance; Professional negligence. 由香港律師會根據專業彌償保險計劃而成立的基金（此等基金自1989年10月1日起取代以前的專業彌償保險計劃），按照此等計劃，彌償只限於從基金中提供，以了結任何針對一名律師或前律師、並與其執業有關的任何種類的民事申索，而任何針對律師的申索須針對基金而進行：《律師（專業彌償）規則》（第159M章）第2、10(1) 及12(1)條。每名在香港從事執業業務的律師，或被人向公眾顯示為在香港從事執業業務的律師，均須透過每年給予保險基金供款而具備與維持此等基金：第6(1)、7(1)及11條。基金須由香港律師彌償基金有限公司持有、管理與經管：第5條。另稱「專業彌償基金」。另見 Professional indemnity insurance; Professional negligence。 |
