In court immunity |
The immunity from suit available to legal practitioners with regard to negligent acts or omissions made in the conduct of court proceedings. No duty of care arises in such situations. The immunity is based on policy considerations, including the duty of the lawyer to facilitate the court proceedings as well as to serve the client’s interests, and the desire to avoid negligence proceedings with regard to matters that have already been litigated: Rondel v Worsley [1969] 1 AC 191 (HL). No action will lie against counsel in respect of words uttered in the course of any judicial proceedings, even if it is alleged that the words were uttered maliciously and without justification, excuse and irrelevant to the issue contested in the proceeding: Munster v Lamb (1883) 11 QBD 588 (CA). See also Barrister; Immunity of barristers; Negligence. 另見 Barrister; Immunity of barristers; Negligence。 |
