释义 | 出生 The act of a child being born. For a birth to take place, the whole body needs to be brought into the world; it is not sufficient that the child respires in the progress of the birth: R v Poulton (1832) 5 C&P 329, 172 ER 997. The moment of a child’s birth is when the child has a life separate from its mother: Law Amendment and Reform (Consolidation) Ordinance (Cap 23) s 22A(4). The father of every child born alive in Hong Kong, or in the case of death, illness, absence, or inability of the father, the mother of such child, shall give information of the birth to the registrar within 42 days after the day of birth: Births and Deaths Registration Ordinance (Cap 174) s 7. The registration form is set out in the Births and Deaths Registration Ordinance (Cap 174) Sch 2 Form 1.
