| 释义 | 生父 A male person who through artificial or natural means impregnated an ova of the biological mother with his own semen, thus resulting in the conception of a child: Parent and Child Ordinance (Cap 429) s 10. A man is presumed to be the biological father of a child if: he was married to the mother when the child was born; or the child was born within the normal period of gestation after the marriage ended (Knowles v Knowles [1962] P 161); or his name is entered in the appropriate birth register as the father: s 5(1). All of these presumptions may [R2] be rebutted on the balance of probabilities: s 5(2). The court cannot compel a man to provide a bodily sample: s 14(1). Where a person fails to comply with a direction by the court to use scientific tests to determine parentage, the court may draw such inferences as appear proper in the circumstances: s 15(1); Re A (A Minor)(Paternity: refusal of blood test) [1994] 2 FLR 463 (CA); Re G (Parentage: blood sample) [1997] 1 FLR 360 (CA). Unless a contrary order is made, a biological father is a joint guardian and custodian of his child: Guardianship of Minors Ordinance (Cap 13) s 3(1)(b). Also known as ‘natural father’.
