The right of a person to argue a case and adduce evidence. Such a right falls under the court or tribunal’s obligation to afford procedural fairness. All persons are equal before the courts and tribunals; in the determination of any criminal charge against him, or of his rights and obligations in a suit at law, everyone is entitled to a fair and public hearing by a competent, independent and impartial tribunal established by law: Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 10; International Covenant on Civil and Political Rights 1966, art 14(1).
