释义 | 人身自由權 The right not to be subjected to arbitrary (or unlawful) arrest or detention (or imprisonment), nor deprived of freedom except and in accordance with procedures established by law: The Basic Law art 28; Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 5(1); International Covenant on Civil and Political Rights 1966 art 9(1); Universal Declaration of Human Rights 1948 art 3. The courts attach great weight to the right to personal liberty and will scrutinise any infringement of the right intensely: for example Bugdaycay v Secretary of State for the Home Department [1987] AC 514, 1 All ER 940; Khawaja v Secretary of State for the Home Department [1984] AC 74, [1983] 1 All ER 765.
