The right in all legal proceedings to a hearing which is fair and public (with some exceptions), before an independent, impartial tribunal. All persons are equal before the courts and tribunals; in the determination of any criminal charge against him, or of his rights and obligations in a suit at law, everyone is entitled to a fair and public hearing by a competent, independent and impartial tribunal established by law: Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 10; International Covenant on Civil and Political Rights 1966, art 14(1). The right to a fair hearing embraces a concept of ‘substantive fairness’ broader than these minimum requirements: State v Zuma [1995] 1 LRC 145. The concept of a fair trial includes not only the obligation of independence and impartiality on the part of judicial authorities, but also respect for the principles of equality of arms, of adversary proceedings, and of expeditious proceedings. 在獨立、無私的審裁處前的所有法律程序接受公平及公開(有若干例外情況)的聆訊的權利。人人在法院或法庭之前,悉屬平等。任何人受刑事控告或因其權利義務涉訟須予判定時,應有權受獨立無私之法定管轄法庭公正公開審問:《香港人權法案條例》(第383章)第8條第十條;《1966年公民權利和政治權利國際公約》第14(1)條。公平審訴的權利包括「實質上公平」的慨念,較最低的要求為闊:State v Zuma [1995] 1 LRC 145。公平審問的慨念不僅包括司法機構的獨立和無私,而且還包括武力均等,對立的法律程序,和效率高的法律程序。另見 Right to a hearing。
