| 释义 | 少數群體的權益 The right of persons belonging to ethnic, religious or linguistic minorities to enjoy their own culture, to profess and practise their own religion, or to use their own language in community with the other members of their group: Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 23; International Covenant on Civil and Political Rights 1966 art 27; Convention on the Rights of the Child 1989 art 30. The indigenous inhabitants of the New Territories cannot be considered to be an ethnic minority for the purposes of art 23 of the Hong Kong Bill of Rights Ordinance (Cap 383): Lau Wong Fat v A-G (1997) 7 HKPLR 307. However, their traditional rights and interests shall be protected by the Hong Kong SAR: Basic Law art 40. See also International Covenant on Civil and Political Rights 1966. 於種族、宗教或語言少數團體之人，與團體中其他分子共同享受其固有文化，信奉躬行其固有宗教或使用其固有語言之權利，不得剝奪之：《香港人權法案》（第383章）第8條第二十三條；《1966年公民權利和政治權利國際公約》第27條；《1989》年「兒童權利公約」第30條。不可以《香港人權法案條例》（第383章）第8條第二十三條視新界的原居民為小數民族：Lau Wong Fat v A-G (1997) 7 HKPLR 307。但他們的傳統權利和權益應由香港基本法保障：《基本法》第40條。另見 International Covenant on Civil and Political Rights 1966。 |
