释义 | 取消資格/喪失資格 1.Taking away a person’s entitlement to do or have something. 2. In the context of road traffic, disqualification means disqualification under the Road Traffic Ordinance from holding or obtaining a driving license: Road Traffic Ordinance (Cap 374) s 2. When a person is convicted of a road traffic offence, the court must or may order him to be disqualified from holding or obtaining a licence for such period as it thinks fit, depending on whether the offence warrants an obligatory or discretionary disqualification. Disqualification runs from the time of the sentence and cannot be consecutive: R v Kent (Peter) [1983] 3 All ER 1, [1983] 1 WLR 794 (CA); R v Meese [1973] 2 All ER 1103, 1 WLR 675 (CCA); R v Tung Koon Ming [1985] 1 HKC 4 (HC); R v Lam Siu Fung [1995] 2 HKC 261 (HC). Under the driving point system, a person who repeatedly commit certain driving offences connected with road safety in circumstances where the individual offences might not warrant disqualification may be disqualified: Road Traffic (Driving-offence Points) Ordinance (Cap 375). At present, person who accumulated 15 or more points in respect of offence committed within two years are liable to disqualification: s 8. Driving whilst disqualified is an offence: Road Traffic Ordinance (Cap 374) s 44. 3. A person is disqualified from adjudicating if he or she has any direct financial interest, however small, in the matter in dispute: R v Hendon RDC, ex p Charley [1933] 2 KB 696; Noble v Inner London Education Authority (1983) 82 LGR 291 (CA). 4. Convicted persons, undischarged bankrupts, judicial and public officers are disqualified from being nominated as a candidate for the position of Chief Executive of the Hong Kong SAR: Chief Executive Election Ordinance (Cap 569) s 14. The same classes of persons are also disqualified from being members of the Legislative Council and members of District Councils: Basic Law art 79; Legislative Council Ordinance (Cap 542) s 15; District Council Ordinance (Cap 547) ss 14, 19, 24.
