A form of easement giving the owner of the dominant tenement an enforceable claim to carry out activities which cause the ground of the servient tenement and the soil below it to subside: Sitwell v Earl of Londesborough [1905] 1 Ch 460. Letting down of the surface is usually associated with mining operations: for example, Westhoughton UDC v Wigan Coal and Iron Co Ltd [1919] 1 Ch 159 (CA).
