释义 | 真實性 The truthfulness of a witness who is under oath. At common law it is possible to call a witness to swear that an opponent’s witness cannot be believed upon oath; the evidence of the witness can only go to the reputation of the opponent’s witness but not specific incidents: Toohey v Metropolitan Police Cmr [1965] AC 595, 1 All ER 506 (HL). Cross-examination is a powerful and valuable weapon for testing the veracity and accuracy of a witness: Mechanical and General Inventions Co and Lehwess v Austin and Austin Motor Co [1935] AC 346 (HL). It is a contempt to publish comment which attacks the veracity of a particular witness: Re Labouchere, ex p Columbus Co Ltd (1901) 17 TLR 578. Medical evidence is admissible to show that a witness suffers from some disease or defect or abnormality of mind which affects the reliability of his evidence: Lowery v R [1974] AC 85, [1973] 3 All ER 662 (PC). Only in very exceptional circumstances will psychiatric evidence be permitted in chief to support the accused’s veracity: R v Turner [1975] QB 834, 1 All ER 70 (CA).
