| 释义 | 代價是否有效 A synonym for the validity or effectiveness of consideration. Sufficient consideration is often described as ‘good’ or ‘valuable’ consideration. Consideration may be sufficient without being adequate: Sum Wing Credits v Shun Yip Textiles [1988] HKC 405. In contract law, a purely nominal consideration will suffice to make a contract binding. Past consideration (German Trade House International Ltd v Lau Wai Ki [1996] 3 HKC 406 (CA)); or, possibly, a promise which is illegal (Lipkin Gorman (a firm) v Karpnale [1991] 2 AC 548, [1992] 4 All ER 512 (HL)) or void (Williams v Williams [1957] 1 All ER 305, 1 WLR 148 (CA)) is no consideration. On the other hand, a compromise of a claim (Fullerton v Provincial Bank of Ireland [1903] AC 309 (HL); a forbearance to sue (Li Shing Tin v Lau Mow Ling [1958] HKLR 1 (FC)); or marriage (Combe v Combe [1951] 2 KB 215, 1 All ER 767 (CA)) might amount to sufficient consideration. Anything which is not unlawful may count as consideration in the eye of the law: Lipkin Gorman (a firm) v Karpnale [1991] 2 AC 548, [1992] 4 All ER 512 (HL). Sufficient consideration may consist of a promise (‘executory consideration’) or an act (‘executed consideration’).
