| 释义 | 附屬信託 A trust created where the owner of equitable property declares himself or herself owner of it for another, under a trust in which the owner imposes active duties on himself or herself. The law is uncertain where the owner places no active duties on himself or herself. A declaration of subtrust is distinguished from an assignment of the interest under the original trust. In the latter case no new interest in property is created. See also Declaration of trust; Trust; Use. 如衡平法財產的擁有人聲明為他人擁有該財產，並根據信託加諸他／她自已積極的職責，則會產生附屬信託。如有關的擁有人沒有加諸他／她自已積極的職責，則在法律上不能確定是否屬附屬信託。信託聲明書有別於原本信託下的權益轉讓。在原本信託下作出的權益轉讓沒有產生新的權益。另見 Declaration of trust; Trust; Use。 |
