释义 | 承兌/接受 The act of assenting to, agreeing; receiving or taking something offered. Bills of exchange - The signification by a drawee of assent to the order of a drawer, requiring the drawee to sign the bill and an expression that the drawee’s promise will be performed only by money payment: Bills of Exchange Ordinance (Cap 19) s 17(1), (2). A drawee is not liable until acceptance: s 53. Only the drawee can accept: Steele v M’Kinlay (1880) 5 App Cas 754; Maxform SpA v Mariani & Goodville Ltd [1979] 2 Lloyd’s Rep 385 (CA). However, in an instrument addressed to no drawee, a person who signs as if accepting the bill can be sued as on a promissory note: Mason v Lack (1929) 140 LT 696. Contract - An acceptance of an offer is an indication, express or implied, by the offeree made whilst the offer remains open and in the manner requested in that offer of the offeree’s willingness to be bound unconditionally to a contract with the offeror on the terms stated in the offer: Halsbury’s Laws of Hong Kong, Vol 7, Contract [115.045].
