Successive independent tortfeasors |
Two or more tortfeasors whose independent and successive acts cause different harm to a plaintiff. The liability of the first tortfeasor extends to the continuing effects of his or her negligence even after a plaintiff is injured by a second tortfeasor: Baker v Willoughby [1970] AC 467, [1969] 3 All ER 1528 (HL). The second tortfeasor is liable only for any additional damage caused by the supervening act. See also Causation. |
