| 释义 | 婚後安排 A settlement brought into existence after a marriage because of that marriage. The court is entitled to make an order varying any post-nuptial settlement for the benefit of the parties to the marriage and of the children of the family or either or any of them: Matrimonial Proceedings and Property Ordinance (Cap 192) s 6(1)(c). The settlement may be constituted by a payment or transfer to a spouse in the nature of continuing provision: In the Marriage of Greer (1985) 10 Fam LR 528. A settlement is not a post-nuptial settlement if it came into existence because the probability of the breakdown of the marriage: In the Marriage of Turnbull (1990) 15 Fam LR 81. Nor is it such a settlement if persons outside the marriage are substantial potential beneficiaries: In the Marriage of Knight (1987) 11 Fam 890.
