释义 | 註明未來日期的支票 A cheque that is dated later than the date of execution. A bill of exchange is not invalid by reason only that it is post-dated: Bills of Exchange Ordinance (Cap 19) s 13(2). The tender of a post-dated cheque on an account on which there is no hope of that cheque being met on presentation is a sufficient deception: Tong Sze Ming v R (CACC 302/82, unreported). If an employee who, contrary to company rules, has accepted a post-dated cheque which was later dishonoured, was not in breach of his implied duty requiring his exercise of skill and care: Mingson Industries Ltd v Lin Shun Hung (DCCJ 6560/90, unreported). If a bill is post-dated, and the payee indorses it and dies before the date arrives, a holder can recover on the bill: Pasmore v North (1811) 13 East 517.
