| 释义 | 關於預付受託財產的法定權力 The power residing in trustee to make an advance from capital subject to a trust for the benefit of a beneficiary who is entitled to the whole or part of the capital of the trust property. Apart from any such express authority conferred by the trust instrument, but subject to any contrary intention expressed in it, under a trust constituted or created after 7 October 1971 where the trust property consists of money or securities or property held on trust for sale trustees have statutory power in their absolute discretion to pay or apply capital money subject to the trust for the advancement or benefit of any person entitled to the capital of the trust property or any share of it, not exceeding altogether in amount half the presumptive or vested share or interest of that person in the trust property, whether the person is entitled to the capital or a share of it absolutely or contingently on his attaining any specified age or on the occurrence of any other event or subject to a gift over on his death under any specified age or on the occurrence of any other event, and whether in possession or in remainder or reversions: Trustee Ordinance (Cap 29) s 34(1). The term ‘advancement’ includes the payment of money to enable an infant to emigrate: Re Dick; Dick v Dick [1940] VLR 166.
