The dismissal of an employee on the basis of serious misconduct on the part of the employee. An employer may terminate a contract of employment without notice or payment in lieu if an employee wilfully disobeys a lawful and reasonable order; misconducts himself, such conduct being inconsistent with the due and faithful discharge of his duties; is guilty of fraud or dishonesty; or is habitually neglectful in his duties or on any other ground on which he would be entitled to terminate the contract without notice at common law: Employment Ordinance (Cap 57) s 9; Ying Kee Safes and Furniture Ltd v Wong Yam Tak [1996] 1 HKC 307; Fong Yee Dung v Swire Properties Management Ltd (LDLA 62/2000, unreported). A summary dismissal by an employer on insufficient grounds would be regarded as a wrongful termination: Star Fair Electronics Co Ltd v Wong Tak Cheung [1985] 2 HKC 92. A summary dismissal can be justified by facts only ascertained by the employer subsequently to the dismissal, and on grounds differing from those alleged at the time: Yeung Chee-kiu v Lam Chee (t/a Yau Fat Furniture Co) [1966] HKDCLR 65.
