Transsexual |
A person born with the sexual characteristics of one sex but who feel that they are of the opposite sex: Bellinger v Bellinger [2003] 2 AC 467, 2 All ER 593, 1 FLR 1043 (HL). The person feels significant disharmony between his or her anatomical sex and gender identification. It is now generally recognised as a psychiatric disorder, often known as gender dysphoria or gender identity disorder; it can result in acute psychological distress: Bellinger v Bellinger, supra. Often the person will try to bring his or her body into conformity with his or her feelings through hormone treatments and surgery. The present state of English law regarding the sex of transsexual people adopts the chromosomal, gonadal and genital tests; if all three are congruent, that should determine a person’s sex for the purpose of marriage: Corbett v Corbett (otherwise Ashley) [1970] 2 All ER 33, [1971] P 83. See also Discrimination; Sex change; Sexuality; Transvestite. n. |
