释义 | 第一主犯 The perpetrator of the offence who, by his own act, brings about the crime or part of a crime: R v Sheppard (1839) 9 Car & P 121. A person may be a principal in the first degree even though he was not present when the criminal act was done if, for example, with the relevant mens rea he contrives injury to another by the use of an innocent agent: R v Cogan, R v Leak [1975] 2 All ER 1059, 61 Cr App Rep 217; [1976] 2 QB 217 (CA). There may be more than one principal and if several persons act together in one unlawful undertaking, all are principals in the first degree: R v Pridmore (1913) 77 JP 339 (CCA).
