| 释义 | 買賣條件 The terms on which an offer to sell may be made and accepted. The conditions of sale will often be stated in writing. To be incorporated into the contract of sale, the conditions of sale must be communicated to bidders, which can be done by notice, for example by exhibition in the auction room or by reproduction in the auction catalogue: Scriven Bros & Co v Hindley & Co [1913] 3 KB 564. Conditions of sale may also be implied. For example, in contract of the sale of goods there is an implied condition that the goods are of merchantable quality: Sale of Goods Ordinance (Cap 26) ss 16, 17; Trade Descriptions Ordinance (Cap 362) s 2.
