释义	獨立承建商 A person who contracts to perform work for another person, but is not employed by that person. An independent contractor is often an alternative to a servant or an employee performing work personally but there are exceptions: Employment Ordinance (Cap 57) s 2; Factories and Industrial Undertakings Ordinance (Cap 59); Sex Discrimination Ordinance (Cap 480) s 2. As a general rule, an independent contractor is someone who carries on a trade or business on his or her own and vicarious liability does not apply on the employer’s part where an independent contractor is employed. However, the exceptions are torts committed by an independent contractor pursuant to the employer’s authorisation or ratification: Ellis v Sheffield Gas Co (1853) 2 E & B 767. Also, an employer could be liable for injuries sustained by an independent contractor where there is a breach of statutory duty: Rainfield Design & Associates Ltd v Siu Chi Moon [2000] 2 HKLRD 226 (CFA). The question of whether or not work was performed by a person in the capacity of an independent contractor was to be regarded by courts as a question of fact to be determined by the courts: Lee Ting Sang v Chung Chi Keung & Anor [1990] 2 AC 374 (PC); Chan Kwok Kin v Mok Kwan Hing & Anor (1990) 2 HKC 65 (CA).
