To falsely and maliciously disparage the title of an owner of real or personal property, and by doing so, unless the circumstances of the case bring it within the statutory exceptions, causes him special damage: Loudon v Ryder (No 2) [1953] Ch 423, 1 All ER 1005. The actions for slander of goods and slander of title, formerly regarded as separate causes of action, are now viewed as examples of the general tort of malicious falsehood: Defamation Ordinance (Cap 21) s 24(1). In an action of slander of title, it shall not be necessary to allege or prove special damage if the words upon which the action is founded are calculated to cause pecuniary damage to the plaintiff and are published in writing or other permanent form; or if the said words are calculated to cause pecuniary damage to the plaintiff in respect of any office, profession, calling, trade or business held or carried on by him at the time of the publication: Defamation Ordinance (Cap 21) s 24(1). For an action to lie, the nature of the property or the nature of the plaintiff’s interest in the property the title of which is disparaged is immaterial. The burden of proving falsity, publication in disparagement of the plaintiff’s title, malice and, where necessary, special damage is on the plaintiff: Royal Baking Powder Co v Wright Crossley & Co (1900) 18 RPC 95 (HL).
