Defamatory statement made or conveyed by spoken words, sounds, looks, signs, gestures, sign language (Gutsole v Mathers (1836) 1 M & W 495, 150 ER 530) or in some other non-permanent form (Gregory v Duke of Brunswick (1844) 6 Man & G 953), published of and concerning the plaintiff, to a person other than the plaintiff, by which the plaintiff has suffered actual damage (Davies v Solomon (1871) LR 7 QB 112), often referred to as special damage, which he must allege and prove, or which is actionable per se at common law (Cassell & Co Ltd v Broome [1972] AC 1027, 1 All ER 801 (HL)), or where the words are calculated to disparage the plaintiff in any office, profession, calling, trade or business carried on by him at the time of publication (Defamation Ordinance (Cap 21) s 23), or where the statement is one of a particular character, ie words imputing unchastity to a woman or a girl (s 21). Slander, even though civilly actionable, is not a criminal offence unless it contravenes the law as being, for example, obscene, blasphemous or seditious or a contempt of court.
