| 释义 | 作為的性質及品質 The physical nature of the act in question. If, at the time of committing a criminal act, a person is labouring under a defect of reason from disease of the mind so as not to know the nature and quality of the act being committed, or if the person did know it but did not know that what he or she was doing is wrong, then the person is not guilty on the ground of insanity: M’Naghten’s case (1843) 10 CL & Fin 200, 8 ER 718; [1843-60] All ER Rep 229. The expression (nature and quality) has always been held to refer to the physical nature and consequences of the act, and does not refer to its moral aspects: R v Codere (1916) 12 Cr App Rep 21 (CCA).
