False oral or written statements made and published with actual malice in disparagement of the plaintiff’s goods, not merely of his title to the goods, and causing special damage: Royal Baking Powder Co v Wright, Crossley & Co (1900) 18 RPC 95 (HL). In an action of slander of goods, it shall not be necessary to allege or prove special damage if the words upon which the action is founded are calculated to cause pecuniary damage to the plaintiff and are published in writing or other permanent form; or if the said words are calculated to cause pecuniary damage to the plaintiff in respect of any office, profession, calling, trade or business held or carried on by him at the time of the publication: Defamation Ordinance (Cap 21) s 24(1). The actions for slander of goods and slander of title, formerly regarded as separate causes of action, are now viewed as examples of the general tort of malicious falsehood: s 24(1).
