Cession |
The transfer of territory or property from one state or government to another. For cession to be effective it must be carried out under treaty and there must be actual physical transfer and a taking of possession by the recipient state. Where transfer of territory has occurred, persons domiciled in the territory ceded become subjects of the acquiring state. An exception is made where the terms of the treaty grant domiciled persons the opportunity to retain their pervious citizenship, however this carries with it the risk of expulsion from the newly ceded territory. The Treaty of Nanking was concluded on 29 August 1842 providing for the cession in perpetuity of the island of Hong Kong to Britain from China. See also Cede; Ceded control. n. |
