The court may order reinstatement on the application of any person aggrieved by the cancellation if it is satisfied that deregistration was as a result of the Registrar’s mistake and it is just that the registration be reinstated: Companies Ordinance (Cap 32) s 291AB(2). Employment - The act of returning to employment an employee who had been dismissed, whether the employee returns to the position from which he or she was dismissed, or to another position within the organisation. An order for reinstatement is an order that the employer shall treat the employee in all respects as if he had not been dismissed or as if there had been no such variation of the terms of the contract of employment: Employment Ordinance (Cap 57) s 32N(4). The restoration of property damaged to the condition in which it was before the damage; in the case of a total loss by rebuilding the building or replacing the goods by their equivalent, as the case may be, and in the case of a partial loss by repairing the damage: Beaumont v Humberts [1990] 2 EGLR 166 (CA). The policy usually gives the insurers an option to reinstate but, unless the policy so provides the obligation of the insurers is to pay money only (Rayner v Preston (1881) 18 Ch D 1 (CA)) and they cannot, without the consent of the assured, substitute a different method of performing their obligation and insist upon reinstating the property (Times Fire Assurance Co v Hawke (1859) 28 LJ Ex 317). An election for or against reinstatement is final once it is made, and cannot afterwards be withdrawn: Sutherland v Sun Fire Office (1852) 14 Dunl 775. 2. The right to revive or continue the insurance policy in accordance with the same terms of insurance cover which has lapsed due to non-payment of a premium. Reinstatement does not mean the creation of a new contract: Pritchard v Merchant’s and Tradesman’s Mutual Life Assurance Society (1858) CBNS 622. If it is reasonable in the circumstances to do so, a court may order that premises be reinstated to its previous condition (Cheung Yeung Kan v Liu Kwan [1973-1976] HKC 237), or that damages amounting to the cost of reinstatement be more than the property is worth (Dominion Mosaics and Tile Co Ltd v Trafalgar Trucking Co Ltd [1990] 2 All ER 246, (CA)).
