释义 | 旁觀者 A person who suffers personal injury or property damage as a consequence of physical proximity to a defective or unsafe product, but who has neither acquired property in nor title to the product, nor used or consumed the product: Kubach & Anor v Hollands & Anor (Frederick Allen & Son (Poplar) Ltd, Third Party) [1937] 3 All ER 907. By the officious bystander test, that is by asking a bystander whether a term is obvious that it goes without saying, the term may be implied if it was necessary to give business efficacy to an agreement: Happy Dynasty Ltd v Wai Kee (Zens) Construction & Transportation Co Ltd [1998] 1 HKLRD 314.
