释义 | 土地財產 Land and interests in land. The term ‘property’ denotes either rights in the nature of ownership or the corporeal things, whether land or goods, which are the subject of such rights. ‘Real’ denotes that the thing itself, or a particular right in the thing may be specifically recovered, under traditional common law meaning: Halsbury’s Laws of Hong Kong, Vol 16, 2001 Reissue, Land [230.0007]. In early common law, only certain legal actions were available to force a defendant to return property to its rightful owner. These actions were called real actions, which were initially only available in respect of freehold land. In Hong Kong, since all land is leasehold, the term applicable should be ‘chattel real’ rather than real property, even though terms like ‘real estate developers’ and ‘real estate agents’ are frequently used: Nield Hong Kong Land Law (2nd Ed, Longman) ch 1 pp 2-4.
