| 释义 | 撤回聲明 In relation to defamation an offer of amends which is expressed as such and which includes a reasonable apology and a reasonable correction in circumstances where a publisher claims that the defamatory publication was innocent. If an offer of amends is accepted by the party aggrieved and is duly performed, no proceedings for libel or slander may be taken or continued by that party against the person making the offer in respect of the publication in question (but without prejudice to any cause of action against any other person jointly responsible for that publication): Defamation Ordinance (Cap 21) s 25(1)(a). Failure to make any retraction of the allegation made is not generally good evidence of malice: Horrocks v Lowe [1975] AC 135, [1974] 1 All ER 662 (HL).
