释义 | 死後無遺下後嗣 Where a person dies without leaving any lineal descendants such as any children or grandchildren able to take under a will or the intestacy rules. In a disposition of property, the words ‘die without issue’, or ‘die without having issue’, or ‘have no issue’, or any other words which may import either a want or failure of issue of any person in his lifetime or at the time of his death, or an indefinite failure of his issue, shall be construed to mean a want or failure of issue in his lifetime or at the time of his death, and not an indefinite failure of issue unless a contrary intention appears from the will: Wills Ordinance (Cap 30) s 22. References to the intestate ‘leaving no issue’ in Intestates’ Estates Ordinance (Cap 73) shall be construed as leaving no issue who attain an absolutely vested interest. See also Descendant; Intestacy rules; Issue. 凡某人去世時,並無遺下任何子女或孫兒、孫女、外孫兒、外孫女等直系後裔,則可根據遺囑或無遺囑遺產繼承原則獲得饋贈。在財產的處置上,「死後無嗣」、「死後無遺下後嗣」、「無嗣」、或表示任何人在生或去世時缺乏後嗣或無後嗣或無限期無後嗣等的任何其他文字,須解釋作該人在生或去世時缺乏後嗣或無後嗣,而非無限期無後嗣,除非遺囑內顯示出相反的意願:《遺囑認證及遺產管理條例》(第30章)第22條。對《無遺囑者遺產條例》(第73章)有關無遺囑者「無遺下後嗣」的提述,須解釋為無遺下絕對既得權益的後嗣。另見 Descendant; Intestacy rules; Issue。 |
