Change of plea |
The variation of a plea originally given to the court by an accused person from not guilty to guilty or vice versa. An accused who has pleaded guilty can change the plea to not guilty at any time until sentence is passed at the discretion of the court: S v Recorder of Manchester [1969] 3 All ER 1230, [1971] AC 481. A court will permit the accused to change the plea to not guilty where the accused did not understand the plea, it was not voluntary, or where there would otherwise be a miscarriage of justice: R v Li Yuen Chu [1994] 2 HKC 621; R v Lam Yin [1995] 2 HKC 74. See also Arraignment; Plea. S v Recorder of Manchester [1969] 3 All ER 1230, [1971] AC 481。 |
