释义 | 惡意中傷 So irrelevant to the proceedings and so abusive or offensive as to justify the court striking it out. The court has power to strike out a pleading or an indorsement of a writ or any part of it if the pleading or indorsement is scandalous: The Rules of the High Court (Cap 4A) O 18 r 19(1)(b). It is impossible to define what interrogatories are scandalous, since the answer depends upon the circumstances of each case: Kennedy v Dodson [1895] 1 Ch 334 (CA). Scandalous matters will include any indecent or offensive matter, or allegations made for the purpose of abusing or prejudicing the opposite party: Re R [1951] P 10, [1950] 2 All ER 117. However, if the allegation is relevant it will not be struck out merely because in other ways it is scandalous: Appleby v Franklin (1885) 17 QBD 93.
