释义 | 惡意中傷法庭 Any act done or writing published which is calculated to bring a court or a judge into contempt, or to lower his authority, or to interfere with the due course of justice or the lawful process of the court, is a contempt of court: Wong Yeung Ng v S-J [1999] 2 HKLRD 293, 2 HKC 24 (CA); S-J v Oriental Press Group Ltd [1998] 2 HKC 627. Only scandalising courts of justice properly so-called and judges of such court is a contempt: Badry v DPP of Mauritius [1983] 2 AC 297, [1982] 3 All ER 973, [1983] 2 WLR 161 (PC). The punishment is inflicted, not for the purpose of protecting either the court as a whole or the individual judges of the court from a repetition of the attack, but of protecting the public, and especially those who either voluntarily or by compulsion are subject to the jurisdiction of the court, from the mischief they will incur if the authority of the tribunal is undermined or impaired: R v Davies [1906] 1 KB 32. In consequence, the court has regarded with particular seriousness allegations of partiality or bias on the part of a judge or a court: Wong Yeung Ng v S-J, supra. On the other hand, criticism of a judge’s conduct or of the conduct of a court (R v Metropolitan Police Cmr, ex p Blackburn (No 2) [1968] 2 QB 150, 2 All ER 319 (CA), even if strongly worded or misguided, is not a contempt provided that the criticism is fair, temperate and made in good faith (Edwards v Almao (No 3) [1957] HKLR 269) and is not directed to the personal character of a judge or to the impartiality of a judge or court (Ambard v A-G for Trinidad and Tobago [1936] AC 322, 1 All ER 704 (PC)).
