| 释义 | 不確定權 In real property law, an uncertain prospect of acquiring an interest in land. A possibility may be bare or coupled with an interest. The primogeniture rule was an example of a bare possibility of an eldest son succeeding to his father’s land. A possibility coupled with an interest arose, for example, where a person has a contingent future interest, it is only a possibility that an interest may arise should the contingent be satisfied. As such, the common law regarded contingent interests as inalienable. It is thought that a contingent interest may now be left by will by virtue of the provisions of the Wills Ordinance (Cap 30) s 3. But there is no statutory means in Hong Kong whereby a contingent interest may be assigned inter vivos at law. In addition, there is also no statutory means for the assignment of contingent remainders in Hong Kong: Nield Hong Kong Land Law (2nd Ed, Longman) ch 8 p 184.
