释义 | 外交特權 The right of certain foreign public officials to be exempted from the operation of certain local laws. Ambassadors and officers of the United Nations Organisation are exempted from criminal proceedings and taxes: Regulations of the People’s Republic of China concerning Diplomatic Privileges and Immunities (5 September 1986) arts 14, 16 (made applicable to the Hong Kong SAR pursuant to promulgation by the Chief Executive under the Basic Law of the Hong Kong SAR of the People’s Republic of China (4 April 1990) art 18 (Promulgation of National Laws 1997 (LN 379 of 1997); International Organisations and Diplomatic Privileges Ordinance (Cap 190) sch 1 pt 1 paras 1, 3; Vienna Convention on Diplomatic Relations 1961 arts 23, 31, 34, 36. Members of staff of the mission of an overseas country ordinarily resident in the People’s Republic of China (including the Hong Kong SAR) are entitled to immunity from jurisdiction in relation to acts performed in the course of their duties: Regulations of the People’s Republic of China concerning Diplomatic Privileges and Immunities (5 September 1986) art 20. Any or all immunities may be withdrawn from persons connected with the mission of a country which grants fewer immunities to persons connected with a mission of the People’s Republic of China in that country than are available in the People’s Republic of China (including the Hong Kong SAR): art 26.
