A means by which a mortgagee may gain priority over a later mortgagee for moneys advanced after the date of the later mortgage. The mortgagee seeking to tack (‘M1’) already has a mortgage over property securing an earlier advance and is in competition with a subsequent mortgagee (‘M2’) for further advances M1 has made after the mortgagor gave a mortgage to M2. The mortgagee’s right to tack further advances has been greatly reduced by legislation. It is now unlikely that the guarantor’s right to the transfer of a mortgage can be postponed, after the debt has been paid, until further advances have also been paid: Nicholas v Ridley [1904] 1 Ch 192 (CA). In relation to mortgages created after 1 November 1984, tacking is allowed under certain conditions: (a) if the subsequent mortgagee so consents, or (b) where the further advance or re-advance does not exceed, with any other outstanding advance or re-advance, the specified maximum amount secured under that prior mortgage, or (c) where that prior mortgage is in favour of an authorized institution (usually a bank, as defined in the Banking Ordinance (Cap 155)) and is expressed to secure all money which may, from time to time, be owing to the prior mortgagee: Conveyancing and Property Ordinance (Cap 219) s 45(1). Conditions (b) and (c) above are effective whether or not the prior mortgagee had notice of the subsequent mortgage at the time when the further advance or re-advance was made by the prior mortgagee: s 45(1).
