释义 | 策略責任 The burden on a party, where the opposing party has discharged the evidential burden on a particular issue, to adduce evidence in reply or run the risk of an adverse finding upon that issue. The tactical burden is not a legal burden of proof. For example, in a summary dismissal case, the employee must firstly prove that his employer terminated the contract and secondly that the dismissal was not for cause, then the tactical burden shifts to the employer to justify the dismissal: Wyldbore v Bayubay [1987] 2 HKC 304 (HC).
