释义 | 按揭優先清償 1. The process by which a holder of an equitable interest can prevail over a prior equitable interest by obtaining the legal estate, provided he or she had no notice of the prior equitable interest at the time of acquiring his or her interest. Tacking is not possible if the equitable interest holder’s acquisition of the legal estate involves the legal holder in a bare trust. This form of tacking has been abolished in Hong Kong: Conveyancing and Property Ordinance (Cap 219) s 45. 2. The process under which a mortgagee adds (‘tacks’) further advances of money to the security of an exiting mortgage to obtain priority over intermediate incumbrancers. 3. The accumulation of periods of adverse possession of land by different persons so as to allow a claimant to establish that there has been a period of adverse possession sufficient to bar the title of the rightful owner. 4.
