| 释义 | 直接後果驗證 Formerly, the test applied to assess whether damage caused by a tortious act was too remote to be recoverable by a plaintiff. Liability was attracted for all damages which were a direct consequence of a person’s negligent act or omission: Re Polemis and Furness, Withy & Co [1921] 3 KB 560, All ER Rep 40. It has since been replaced by the foreseeability test: Overseas Tankship (UK) Ltd v Morts Dock & Engineering Co Ltd (The Wagon Mound) [1961] AC 388; Wong Wai Ming v Hospital Authority [2000] 4 HKC 330.
