释义 | 授產衡平法 Formerly, the right (‘equity’) in a wife to a reasonable provision (for herself and her children) out of the wife’s property which her husband was seeking to recover in a court of equity: Brown v Elton (1733) 24 ER 1030, 3 P Wms 202. The court only allowed the husband to recover the property subject to the wife’s equity to a settlement. The normal rule was that one-half of the property should be settled on the wife, but in appropriate cases it could be higher. The court’s jurisdiction was based on the fact that the property was the wife’s sole means of maintenance, and on the parental care the court exercised for the benefit of orphans: Jewson v Moulson (1742) 2 Atk 417, 26 ER 652. Since the passing of married woman’s property legislation, married women do not need their husband’s assistance to recover their property, and so the concept is now obsolete.
